Waldorf Doll Pattern
Is a sewing pattern infringing on something copyrighted?
I have a blog where I have sewing patterns and tutorials. I made a little one sentence blurb on a blog entry from several weeks ago that said I was working on a doll sewing pattern, a half animal/human doll. This is for a style of waldorf doll. I had never seen one aside from the pattern I am designing, but someone who has made these types of dolls and sells them says I am violating her copyright and to “not copy” her original design.
My end product will be a sewing pattern not a doll to sell. And I had no prior knowledge of this person’s work nor seen her work until she emailed it to me. So how can this be a violation of copyright?
She gives me the impression she thinks I bought her dolls (over $100 a doll), ripped them apart and copied the pieces into a sewing pattern. I’ve been designing this pattern very sporadically for years by designing the pieces and then sewing it up to see if a particular design works best.
Does she have a patent or copyrighted anything? (In this last case you can still produce it). Go ahead and try to patent the sewing pattern yourself. Be quick about it. You may still face problems in court, if she establishes prior use before any of yours documented uses. Consult a patent lawyer, though that may be expensive. It isn’t unheard of, that two people come up with the same idea at about the same time. What you have to do is establish priority by the means legally available.
